In Florida, workers' compensation wage-replacement benefits are governed by Chapter 440 of the Florida Statutes (Fla. Stat. § 440.12 and § 440.15) and regulated by the Florida Department of Financial Services, Division of Workers' Compensation.

When an employee suffers an injury arising out of and in the course of employment that causes temporary total disability, they are entitled to Temporary Total Disability (TTD) benefits. Under Florida Statute § 440.15(2), TTD is calculated at 66 2/3% (66.67%) of the employee's Average Weekly Wage (AWW). The AWW is determined by averaging the employee's gross earnings over the 13 weeks immediately preceding the date of accident.

For accidents occurring in 2024, the statutory maximum weekly benefit in Florida is $1,260.00. The statutory minimum weekly benefit is $20.00 (or the employee's actual wage if less). Florida applies a 7-day waiting period. Compensation is not paid for the first 7 days of disability unless the disability lasts longer than 21 days, in which case benefits are paid retroactively to day one.

Under Florida Statute § 440.15(2)(a), temporary disability benefits are strictly capped at an aggregate maximum duration of 104 weeks, or until the worker reaches Maximum Medical Improvement (MMI), whichever occurs first.

Once an authorized treating physician determines MMI, the worker is assessed for permanent impairment. Permanent Impairment Benefits (IB) are paid according to a tiered statutory duration schedule under Fla. Stat. § 440.15(3), providing 2 to 6 weeks of benefits per percentage point of impairment, paid at 75% of the worker's TTD rate.

Important Limitations: This calculator provides estimates for temporary wage-replacement benefits. It does not calculate permanent impairment ratings, medical treatment costs, statutory attorney fees, or negotiated lump-sum settlement releases under Fla. Stat. § 440.20(11).
