In New York, workers' compensation wage-replacement indemnity is established under the New York Workers' Compensation Law (NY WCL § 15) and administered by the New York State Workers' Compensation Board (WCB).

An employee who is totally unable to work while recovering from an occupational injury is entitled to Temporary Total Disability (TTD) indemnity. Under NY WCL § 15, the weekly benefit rate is calculated as two-thirds (66.67%) of the worker's average weekly wage (AWW), multiplied by the percentage of medical disability. For total temporary disability (100%), the full 66.67% rate applies. The AWW is determined based on payroll wages in the 52 weeks preceding the date of accident.

For injuries occurring on or after July 1, 2023 (effective through the 2024 benefit year), the maximum weekly benefit is $1,145.43. The statutory minimum benefit is $275.00 per week, or the worker's full weekly wage if their AWW is less than $275.00. New York enforces a 7-day waiting period; benefits are not paid for the first 7 days unless the disability continues beyond 14 days, in which case benefits are retroactive to the date of disability.

Unlike many states, New York does not impose an arbitrary 104-week statutory duration cap on Temporary Total Disability. TTD payments continue as long as medical evidence substantiates temporary total disability until the worker reaches Maximum Medical Improvement (MMI).

Permanent disability is evaluated once MMI is achieved. Extremity injuries are rated under the Schedule Loss of Use (SLU) system for specific bodily members. Non-schedule injuries (such as spine or head conditions) are evaluated based on Loss of Wage-Earning Capacity (LWEC) under § 15(3)(w), which caps post-2007 benefit duration between 225 and 525 weeks.

Important Limitations: This calculator estimates temporary wage-replacement benefits. It does not calculate clinical SLU percentages, LWEC classifications, or Section 32 lump-sum waiver agreements.
